General Use

When you download or upload templates from/to MyTemplatez you agree, on behalf of yourself and any company or organization on whose behalf you actually or allegedly act, you indicate that you have read and understand these Terms and Conditions, and that you agree to them and intend to be legally bound by them.

If you do not agree to these Terms and Conditions, you are not granted permission to use MyTemplatez and must exit immediately.

The completion of registration and site usage confirms your acceptance of and binding to Terms of Use, as well as confirms that none of the information you are providing is fraudulent or incorrect and is complete. Provision of incomplete, false or fraudulent information breaches this contract and its terms. By agreeing to these terms and conditions, you fully indemnify MyTemplatez.

MyTemplatez reserves the right at any time to modify, alter or update these Terms of Use. Your use of the MyTemplatez following any changes means that you agree to follow and be bound by the terms as changed. It is the obligation of users visiting MyTemplatez before the change to learn of changes to the Terms and Conditions since their last visit. Any change to the Terms and Conditions shall be effective as to any visitor who has visited MyTemplatez before the change was made.

MyTemplatez must not be used by children under 13.

Refusal Of Service/Usage

MyTemplatez reserves the right to refuse, cancel, or suspend your membership/template usage at its sole discretion.

Legal Rights

MyTemplatez retains the right to take legal action, and solve legal disputes, in cases including but not limited to suspicion of fraud or misuse of MyTemplatez. MyTemplatez is not obligated to take any actions when a complaint is made about fraud or otherwise. All decisions made by MyTemplatez and its site administrators are final.

Severability

If any term or provision of these Terms and Conditions is found to be unenforceable for any reason, these Terms and Conditions shall remain in full force and effect and shall be fully enforceable on its remaining terms and conditions.

Submitted Free Templates to MyTemplatez

By uploading your templates, you affirm, represent, and warrant that:

• You are the creator and owner of or have the necessary licenses, rights and permissions to upload templates and your templates contains only materials that you own or have permission to use. You may not submit templates that you have simply found nor are you able to modify templates and submit them back. For clarity, MyTemplatez does not permit copyright infringing activities on the site.
• Your templates do not and will not: (a) infringe, violate, or misappropriate any third-party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right. (b) your templates do not contain any viruses, Trojan horses, worms, time bombs, cancelbots, or other computer programming routines that damage, detrimentally interfere with, surreptitiously intercept, or expropriate any system, data or personal information, or that facilitate or enable such or that are intended to do any of the foregoing. Violators of these third-party rights may be subject to criminal and civil liability. MyTemplatez reserves all rights and remedies against any Users who violate these Terms and Conditions.
• MyTemplatez reserves the right to add the link "Downloaded from Free Website Templates" to the footer of templates submitted to MyTemplatez.

If you believe that any content on the MyTemplatez violate your intellectual property or other rights, please follow our Complaint Procedure in DMCA Notification Guidelines.

MyTemplatez License Agreement

• This agreement only apply for Templates designed by MyTemplatez. See "3rd Party Templates License Information" for more information on 3rd party templates licenses.
• Templates designed by MyTemplatez are licensed under a Creative Commons Attribution 3.0 License in accordance with these Terms and Conditions issued by MyTemplatez.
• You may not claim intellectual or exclusive ownership to any of MyTemplatez Templates, modified or unmodified. All products are property of MyTemplatez and they are protected by copyright law.
• MyTemplatez Templates are provided "as is" and without warranties, including but not limited to any warranties of accuracy, reliability, merchantability or fitness for a particular purpose by any vendor, customer, or associate offering information, products, any services linked to the MyTemplatez website. User must assume the entire risk of using MyTemplatez Templates.
• By downloading and using MyTemplatez Templates You agree not to make claims any damage caused directly or indirectly as a result of using MyTemplatez Templates.
• All MyTemplatez Templates remain a property of MyTemplatez. You can use the MyTemplatez Templates in development of commercial or non-commercial projects. MyTemplatez does not allow you to use the templates for websites or individuals that participate in warez, hacking, cracking, malicious computer crime or fraud, or any other material or activity that is illegal.
• When using MyTemplatez Templates, You have the right to:
  • use the MyTemplatez Templates for commercial and non-commercial purposes.
  • make any necessary modification(s) to our templates to fit your purposes.
  • change name, logo, category, color range of the template.
  • change or remove photos, fonts and any other elements of design at your own discretion, except the authors' links.
• You can't remove, substitute or indicate through redirect any of the authors' links placed in each MyTemplatez Templates. These links are mandatory for using MyTemplatez Templates. Removal, substitution or any other change of the authors' links put in MyTemplatez Templates is regarded as violation of the present Terms of Use and copyright infringement towards their owner.

3rd Party Templates License Information

All of the 3rd Party Templates are licensed, make sure you read and understand the license for any template you download before using it.

• First and foremost, each and every 3rd Party Template is property of the original author. MyTemplatez is not the official author of these templates unless they have been created by MyTemplatez.
• 3rd Party Templates distributed at MyTemplatez each carry their own separate license agreement which is chosen by their designer/developer.
• Terms of use can be found on or in: (a) downloaded ZIP file, (b) possibly within the live demo page or (c) designer/developers web site.
• Upon downloading a template, you agree to use the template under its respected license agreement.
• Any specific information included with the file upon download such as license information is binding to that template.
• If any copyright infringement or other issued against the authors requests are found we will be in full compliance with the author if he/she chooses to take action.
• Please be respectful to original authors as they have put time and effort into their work.

Premium Templates License

One Time Usage License

• You may be granted a One Time Usage License in case of purchasing a website template at a Non-Unique Price. It enables you to use each individual product on a single website (one domain) only, belonging to either you or your client. You have to purchase the same template again if you to use the same design in connection with another or other projects;
• You may not claim intellectual or exclusive ownership to this template, modified or unmodified.
• This template is provided "as is" without warranty of any kind.
• We are not responsible for the similarity between this and other templates or websites.
• You may not sublicense, distribute, resell copies of this template package to others.
• You may modify the template on your own or using other designers services and change it to suit your needs. To do that you need to have knowledge of using Adobe Photoshop, Adobe Illustrator, any Html editor, and eventually Macromedia Flash if the template contains Flash.
• After purchasing you will receive a download link that will expire after three downloads. If you want to reactivate that link just Contact Us.

Unique Purchase License

• You may be granted a Unique Purchase License in case of purchasing a website template at a Unique Price. This type of license guarantees that you are the first and the last person to buy this template from us. It means that this template has not been sold before and you become an owner of a unique design. After this kind of purchase the template is being permanently removed from our sales directory and is never available to other customers again.
• The Unique Purchase License allows you to develop the unlimited number of projects based on this template, but the template should be customized differently for every project.
• You may not claim intellectual or exclusive ownership to this template, modified or unmodified.
• This template is provided "as is" without warranty of any kind.
• You may not sublicense, distribute, resell copies of this template package to others.

Buyout Purchase License

• You may be granted a Buyout Purchase License in case of purchasing a website template at a Buyout Purchase Price. This type of license guarantees that you are the last person to buy this template. After the buyout purchase occurs, the template is permanently removed from our store and is never available to other customers again.
• The Buyout Purchase License allows you to develop the unlimited number of projects based on this template, but the template should be customized differently for every project.
